Terms and Conditions of Use
No person, whether ATA-certified or not, may use the ATA-certified Translator Seal (the "Seal") or any imitation, facsimile or copy of it in any manner or for any purpose whatsoever unless and until he/she shall has entered into this agreement with the American Translators Association ("ATA" or "Association").
Please read the following Terms and Conditions of Use carefully before downloading the Seal. These Terms and Conditions of Use constitute a binding written agreement between you and ATA.
By accessing, downloading, or using the Seal, you acknowledge that you have read and understood, and agree to be bound by these Terms and Conditions of Use and to comply with any and all applicable laws and regulations.
Copyright and Trademark
The Seal was developed for the exclusive use of ATA members in good standing who have been certified as translators by the Association. It is the exclusive property of the ATA and is protected by applicable copyright and trademark law. All uses of the Seal are subject to review and approval by ATA. The Association reserves the right to take any and all steps it deems appropriate, including legal or other action, to protect its rights in the event of any unauthorized, improper, or impermissible use of the Seal.
Use of the Seal is restricted to individuals who at the time that they affix the Seal to any document, shall have passed the ATA certification examination, who have maintained their credential through compliance with all relevant requirements for recertification, and who are then ATA members in good standing.
Permission to Use
ATA grants you a limited, non-transferable permission to download, display, and otherwise use the Seal, which bears your name, certification number, and language pair and direction, solely in the manner described in these Terms and Conditions of Use. This permission to use the Seal is restricted to ATA members in good standing and is conditioned on your compliance with these Terms and Conditions of Use.
Manner and Restrictions of Use
Term, Cancellation of Use, and Changes to Terms and Conditions of Use
The term of your permission to use the Seal shall continue as long as you are in compliance with these Terms and Conditions of Use.
If, however, you violate the Terms and Conditions of Use, your permission to use the Seal shall automatically be cancelled. Cancellation shall not require any prior notice of any kind, either actual or constructive, to terminate your permission to use the Seal or prejudice any of ATA's rights.
In the event of any such cancellation of this permission, you must immediately cease use of the Seal.
Notwithstanding any of the foregoing, ATA reserves the right to terminate the right to use the Seal by anyone at any time, and reserves the right to change these Terms and Conditions of Use at any time, without any prior notice of any kind, at its sole discretion.
Limitation of Liability
Use of the Seal shall not imply endorsement by ATA. The Association assumes no responsibility, and expressly disclaims any responsibility, for the accuracy, reliability, and performance of any individual using the Seal.
In no event shall ATA be liable to any party for lost profits, business interruption, lost savings, or damages of any other type related to or arising from the use of the Seal.
You agree to defend, indemnify, and hold ATA, its directors, officers, members, agents, and employees harmless from and against all claims, liabilities, costs and expenses, including attorney's fees, arising out of acts, omissions, or breach of these Terms and Conditions of Use by you or your agents.
